{"id":6997,"date":"2022-03-24T07:18:46","date_gmt":"2022-03-24T07:18:46","guid":{"rendered":"https:\/\/vazquezymanchon.com\/no-existe-plazo-especifico-prescripcion-ejercicio-del-derecho-instar-la-ejecucion-las-resoluciones-emitidas-los-tribunales-economico-administrativos\/"},"modified":"2025-09-17T08:50:53","modified_gmt":"2025-09-17T08:50:53","slug":"no-specific-time-limit-prescription-of-the-right-to-request-enforcement-of-resolutions-issued-by-the-economic-administrative-courts","status":"publish","type":"post","link":"https:\/\/vazquezymanchon.com\/en\/no-specific-time-limit-prescription-of-the-right-to-request-enforcement-of-resolutions-issued-by-the-economic-administrative-courts\/","title":{"rendered":"\u00bfHay plazo de prescripci\u00f3n para ejecutar resoluciones de los Tribunales Econ\u00f3mico-Administrativos"},"content":{"rendered":"<h2>Resoluci\u00f3n<\/h2>\n<p><a href=\"https:\/\/www.fiscal-impuestos.com\/sites\/fiscal-impuestos.com\/files\/NFJ075475.pdf\"><b>(TEAC, de 15-07-2019, RG 2147\/2016)<\/b><\/a><\/p>\n<p><span style=\"font-weight: 400;\">En este art\u00edculo comentamos un caso relacionado con el <\/span><b>plazo de prescripci\u00f3n<\/b><span style=\"font-weight: 400;\"> del derecho a instar <\/span><b>la ejecuci\u00f3n de las resoluciones emitidas por los Tribunales Econ\u00f3mico-Administrativos.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En particular, versa sobre una resoluci\u00f3n estimatoria del TEAR de Catalu\u00f1a de 14 de diciembre de 2006 sobre IVA y subvenciones que nunca lleg\u00f3 a ejecutarse por la Administraci\u00f3n. En 2015, una de las partes afectadas solicit\u00f3 una rectificaci\u00f3n de la declaraci\u00f3n fiscal presentada en 2006. La administraci\u00f3n desestim\u00f3 este hecho por considerarse prescrito <\/span><b>seg\u00fan la Ley General Tributaria<\/b><span style=\"font-weight: 400;\">, que contempla <\/span><b>cuatro a\u00f1os<\/b><span style=\"font-weight: 400;\"> como plazo de prescripci\u00f3n. Sin embargo, al no tratarse de un acto tributario, sino de la ejecuci\u00f3n de una sentencia, <\/span><b>no aplicar\u00eda dicho plazo de prescripci\u00f3n<\/b><span style=\"font-weight: 400;\">, sino el que se establece por el Derecho Com\u00fan (<\/span><b>15 a\u00f1os<\/b><span style=\"font-weight: 400;\"> conforme se\u00f1ala el art\u00edculo 1964.2 del C\u00f3digo Civil), por lo que en la misma el TEAR estima la pretensi\u00f3n del recurrente y por ello se ordena la anulaci\u00f3n de los acuerdos impugnados y la retroacci\u00f3n de las actuaciones.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Esto se debe a que e<\/span><span style=\"font-weight: 400;\">l TEAC tiene en consideraci\u00f3n que lo que el interesado inst\u00f3 fue la ejecuci\u00f3n de una resoluci\u00f3n econ\u00f3mico-administrativa, cuyo plazo de prescripci\u00f3n de este derecho no se especifica en la normativa tributaria, por lo que procede aplicar el general, y a la fecha de solicitud de reanudaci\u00f3n de la ejecuci\u00f3n, no habiendo prescrito tal derecho, procede continuar con la mencionada actuaci\u00f3n para ejecutar lo que determina en su resoluci\u00f3n el TEAR.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En otras palabras, en la sentencia se se\u00f1ala que el derecho a instar la ejecuci\u00f3n de esta no prescribe a los 4 a\u00f1os, seg\u00fan indica la LGT, sino conforme al plazo de prescripci\u00f3n general que establece el Derecho Com\u00fan, (15 a\u00f1os, conforme al art\u00edculo 1964.2 del C\u00f3digo Civil), ya que prevalece el
