{"id":7021,"date":"2020-01-02T00:00:40","date_gmt":"2020-01-02T00:00:40","guid":{"rendered":"https:\/\/vazquezymanchon.com\/comparativa-despido-procedente-improcedente-nulo\/"},"modified":"2025-09-17T10:19:45","modified_gmt":"2025-09-17T10:19:45","slug":"comparison-fair-unfair-and-null-dismissals","status":"publish","type":"post","link":"https:\/\/vazquezymanchon.com\/en\/comparison-fair-unfair-and-null-dismissals\/","title":{"rendered":"Despido procedente, improcedente y nulo, \u00bfCu\u00e1les son sus diferencias?"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"7021\" class=\"elementor elementor-7021 elementor-1852\" data-elementor-post-type=\"post\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-6d1c64a7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"6d1c64a7\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;jet_parallax_layout_list&quot;:[]}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-35a93a87\" data-id=\"35a93a87\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ecdeafd elementor-widget elementor-widget-text-editor\" data-id=\"ecdeafd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Como hemos comentado en los art\u00edculos anteriores relacionados con los tipos de despido, se establecen dos clasificaciones de los despidos:<strong>\u00a0una es en funci\u00f3n de la causa que los motive, y otra es la calificaci\u00f3n legal que efect\u00fae el juez del mismo.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0fb8c0f elementor-widget elementor-widget-heading\" data-id=\"0fb8c0f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Diferencias entre los diferentes tipos de despido<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fda5347 elementor-widget elementor-widget-heading\" data-id=\"fda5347\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Despido Disciplinario<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-86a3f0a elementor-widget elementor-widget-text-editor\" data-id=\"86a3f0a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>En el supuesto de que el despido sea disciplinario y el juez lo catalogue como procedente, la relaci\u00f3n laboral quedar\u00e1 extinguida sin que el trabajador tenga derecho a indemnizaci\u00f3n.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2ca2b40 elementor-widget elementor-widget-heading\" data-id=\"2ca2b40\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Despido por causas objetivas<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cccb9f9 elementor-widget elementor-widget-text-editor\" data-id=\"cccb9f9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>En el caso de que el despido se haya producido por causas objetivas y se categorice como procedente, el trabajador podr\u00e1 beneficiarse de la indemnizaci\u00f3n de veinte d\u00edas por a\u00f1o de servicio, con un m\u00e1ximo de doce mensualidades.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-629f333 elementor-widget elementor-widget-heading\" data-id=\"629f333\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Despido improcedente<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5833178 elementor-widget elementor-widget-text-editor\" data-id=\"5833178\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>El despido improcedente es aquel que no ha seguido el procedimiento adecuado o que no cuenta con causas objetivas. La catalogaci\u00f3n de improcedente por parte del juez conlleva una de estas consecuencias, a elecci\u00f3n de la empresa:<\/p>\n<ul>\n<li><strong>Indemnizaci\u00f3n<\/strong>: cuya cuant\u00eda depende de la antig\u00fcedad del trabajador y de su remuneraci\u00f3n.<\/li>\n<li><strong>Readmisi\u00f3n<\/strong>: del trabajador en su puesto habitual, percibiendo adem\u00e1s el abono de los sueldos que este haya dejado de percibir desde que se produce el despido hasta que se le reintegra en la empresa.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8975bd8 elementor-widget elementor-widget-heading\" data-id=\"8975bd8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Despido nulo<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e3e0b77 elementor-widget elementor-widget-text-editor\" data-id=\"e3e0b77\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Por \u00faltimo, tambi\u00e9n puede darse el caso de que el juez declare el despido como nulo, que es aquel que no cuenta con causa objetiva, pero que adem\u00e1s se ha efectuado a un trabajador especialmente protegido.<\/p>\n<p>Ser\u00e1n declarados nulos los despidos discriminatorios por cualquier conducta prohibida por la Constituci\u00f3n Espa\u00f1ola o cuando se violen derechos fundamentales del trabajador. Tambi\u00e9n aquellos que se produzcan en alguna de estas circunstancias:<\/p>\n<ul>\n<li>Despido de trabajadoras durante el permiso de maternidad, riesgos en el embarazo, lactancia, enfermedades derivadas del embarazo, o en supuestos de adopci\u00f3n, acogimiento o paternidad.<\/li>\n<li>Despido de cualquier trabajadora embarazada desde la fecha de inicio del embarazo.<\/li>\n<li>Despido de un trabajador que haya solicitado o est\u00e9 disfrutando de permisos por lactancia, nacimiento de un hijo prematuro, guarda legal, o enfermedades graves que requieran hospitalizaci\u00f3n o tratamiento continuado.<\/li>\n<li>Despido de un trabajador que haya solicitado o est\u00e9 disfrutando de una excedencia para atender a hijos o familiares enfermos.<\/li>\n<li>Despido que afecte a v\u00edctimas de violencia de g\u00e9nero.<\/li>\n<li>Despido de trabajadores tras reincorporarse a su puesto habitual despu\u00e9s de periodos de maternidad, paternidad, adopci\u00f3n o acogimiento.<\/li>\n<\/ul>\n<p>La consecuencia del despido nulo es la obligatoriedad de la empresa de reincorporar al trabajador y abonarle los salarios de tramitaci\u00f3n.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6181d32 elementor-widget elementor-widget-heading\" data-id=\"6181d32\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Conclusi\u00f3n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d34cc7 elementor-widget elementor-widget-text-editor\" data-id=\"2d34cc7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>En conclusi\u00f3n, los despidos pueden catalogarse de diferente forma por parte del juez, y es importante atender a esta clasificaci\u00f3n, ya que supondr\u00e1 la diferencia en las consecuencias que se deriven de los mismos.
